According to producer Motohide Eshiro and co-director Takeshi Yamazaki, the idea of rotating between three different attorneys in both games (Phoenix Wright, Apollo Justice, and Athena Cykes) allowed the writers to explore each of them at different points in their professional careers and how their personalities handled it, despite Phoenix Wright generally being considered the main protagonist. Yamazaki explained:
"Phoenix, he's really mature, he's this mentor now, he's basically a super-lawyer, [so] we were able to give him a much more difficult task. He can go to this foreign country and try to do different things in this country, whereas Apollo is kind of still in his starting-out phase. He's not completely a new guy, but he's not really [at] that super level like Phoenix. So we can write a story where it's more built around his growth as a lawyer. And then with Athena, she starts out in Ace Attorney 5 especially (Dual Destinies) as literally the newest person in the office. So we were able to give her her own unique storyline as well and have her start from that unique position of being the youngest person in the office and the newest person in the office."

According to series creator Shu Takumi, the hometown of the Fey clan, Kurain Village, is named after the Klein bottle, a geometric one-sided surface that has no distinct inside or outside. He felt that the name was "perfect for the theme of spirit channeling".

The Khura'in princess Rayfa was designed to act as an opponent to Phoenix Wright, despite being labeled a heroine in her home country. Co-director Takeshi Yamazaki and producer Motohide Eshiro felt that in order for her to be a believably tough character for Phoenix to beat, she had to be "kind of standoffish" and highly confident. They felt that this approach, as opposed to having her be on Phoenix's side, brought something new and fresh to the series.

Between February 25 and March 16, 2016, Capcom ran a promotional campaign on their Japanese Twitter account called the "Everyone! Support Tweet Campaign" by encouraging fans to post a tweet or retweet using the hashtag "#逆転裁判6応援" (Gyakuten Saiban 6 Support). The rewards for the campaign included smartphone wallpapers of Phoenix, Apollo, and Athena, with an 8-minute long anime prologue that would not be included in the game being the highest goal at 18,000 hashtags. This threshold was quickly surpassed, with the final count reaching 55,589 hashtags and being rewarded with an additional wallpaper of Maya.
